Abstract

The author discusses the concept of "investigative error" in criminal procedural activity of the investigator. Identifies causes of errors, such as, information uncertainty and gaps in the legislation. Based on the analysis of different points of view of scientists, the author draws a conclusion about the error as a negative consequence of risk in the activities of the investigator. The article is intended for lawyers, researchers, students involved in the study of the criminal procedural aspects of the preliminary investigation.

Автором статьи рассматривается понятие «следственной ошибки» в уголовно процессуальной деятельности следователя. Выявляются причины возникновения ошибок, такие как, информационная неопределенность и пробелы в законодательстве. На основе анализа разных точек зрения ученых, делается вывод об ошибке как негативном последствии риска в деятельности следователя. Статья предназначена для юристов, исследователей, студентов, занимающихся изучением уголовно-процессуальных аспектов предварительного следствия.
