Abstract

В статье рассматривается одна из важнейших проблем общей части науки уголовного права проблема единого составного преступления. Показано соотношение понятия составного преступления с идеальной совокупностью преступлений, анализируется научная дискуссия вокруг понятия "деяния, содержащего признаки преступлений, предусмотренных разными статьями Уголовного кодекса", широко использовавшегося законодательством времен первых российских уголовно-правовых актов, приводится дискуссия вокруг проблем отождествления и разграничения составного преступления и идеальной совокупности преступлений.

In article one of the major problems of the General part of a science of criminal law a problem of a uniform compound crime is considered. The parity of concept of a compound crime with ideal set of crimes is shown, scientific discussion round concept "the act containing signs of crimes, provided by different articles of the criminal code", widely used by the legislation of times of the first Russian criminally-legal certificates is analyzed, discussion round problems of an identification and differentiation of a compound crime and ideal set of crimes is resulted.
