О некоторых аспектах ограничения деятельности иностранных организаций в стране (российский и зарубежный опыт)

Abstract

В статье рассмотрены вопросы законодательных ограничений деятельности иностранных организаций на территории государства. Характеризуется принцип национального режима иностранцам. Рассматривается система мер ограничительного и контролирующего характера, раскрываются установленные национальным законодательством виды ограничений для иностранцев собственников. Исследованы формы государственного регулирования деятельности иностранных компаний: ограничение доли иностранного инвестора в капитале национальных предприятий, ограничение в управлении производством, определение максимальной доли при распределении прибыли, условия выдачи и действие лицензий, патентов.
