Составы преступлений с альтернативными признаками объективной стороны в истории уголовного законодательства советской и постсоветской России

Abstract

The article develops the notion of corpus delicti with alternative signs of objective part, shows the types of alternative signs. The author comes to the conclusion that the presence of alternative signs of objective part determines the existence of a single complex crime (single corpus delicti). The author traces the practice of formulation of corpus delicti with alternative signs of objective part according to the Russian Criminal Codes of 1922, 1926 and 1960, as well as 1996.

В статье раскрывается понятие составов преступлений с альтернативными признаками объективной стороны, показываются виды альтернативных признаков и делается вывод, что при наличии альтернативных признаков объективной стороны имеет место единое сложное преступление (единый состав преступлений). Автор прослеживает практику формулирования составов с альтернативными признаками объективной стороны по УК РСФСР 1922 г., 1926 г. и 1960 г., а также по УК РФ 1996 г.
