E-mail: tkachevanv@susu.ru. В статье отмечается, что внедрение цифровых технологий во все сферы жизни требует нового формата работы органов государства, обеспечивающих законную деятельность человека. Несмотря на совершенствование и введение цифровых технологий в нотариальную деятельность, расширение спектра нотариальных действий и полномочий частных нотариусов, закрепление и применение уголовно-правовой нормы, предусматривающей уголовную ответственность частных нотариусов, обусловлено и играет значимую роль, так как отвечает задачам уголовного закона и реализует законные интересы личности, общества и государства. Так как злоупотребление полномочиями частными нотариусами путем осуществления своих полномочий в том числе и с использованием цифровых технологий – удостоверение недействительных сделок, фиктивных доверенностей и завещаний и др., в большинстве случаев не является целью, а представляет базис для совершения другого преступления либо самим нотариусом, либо другим лицом по заранее обусловленной договоренности, как правило, путем сговора. Снижение уровня преступлений в анализируемой сфере преступности, в первую очередь помимо работы правоприменителя, связан с внедрением инновационных технологий в работу нотариата, что позволяет усилить и обеспечить уровень правовой защиты. The article notes that the introduction of digital technologies in all spheres of life requires a new format for the work of state bodies that ensure legal human activities. Despite the improvement and introduction of digital technologies in notary activities, the expansion of the range of notary actions and powers of private notaries, the consolidation and application of the criminal legal norm providing for the criminal liability of private notaries, is determined and plays a significant role, since it meets the objectives of the criminal law and realizes the legitimate interests of the individual, society and the state. Since the abuse of powers by private notaries through the exercise of their powers, including using digital technologies - certification of invalid transactions, fictitious powers of attorney and wills, etc., in most cases is not a goal, but represents a basis for committing another crime or by the notary himself , or by another person on a predetermined agreement, usually by con-spiracy. Reducing the level of crimes in the analyzed area of crime, primarily in addition to the work of the law enforcement officer, is associated with the introduction of innovative technologies in the work of the notary, which allows strengthening and ensuring the level of legal protection.
