Η παρούσα Διπλωματική Εργασία ασχολείται με την εξέταση των καθεστώτων του Res Judicata και του Lis Pendens στο πλαίσιο της επενδυτικής διαιτησίας. Αρχικά εξετάζονται τα θεμελιώδη στοιχεία των δυο αυτών καθεστώτων στο πλαίσιο διαφορετικών εννόμων τάξεων ενώ ταυτοχρόνως καθορίζεται η εφαρμογή αυτών από εσωτερικά και διαιτητικά δικαστήρια. Επιπροσθέτως, ερευνάται κατά πόσο είναι δυνατή η εφαρμογή των waiver και των consolidation clauses ως μέσο αποφυγής του λεγόμενου double recovery των μερών.

This Master Thesis seeks to achieve its aims in certain stages. First, one examines the constituent elements of res judicata and lis pendens in different legal systems, analyzing the doctrines as applied in both domestic laws and in international law. Two, will define to what extent the two doctrines may be applied by arbitral tribunals and domestic courts. Third will determine the meaning and the application of waiver clauses and consolidation clauses in BITs.
