The aim of the article is to conduct, for the first time in Spanish studies, a contrastive analysis of the verbalization of the engagement ritual and the consequences of its dissolution in Russian, Spanish and some Latin American cultures through the prism of discursive contexts (legal, media and literary). The study of mutual correspondences and differences of the betrothal ritual as a socially oriented model of behaviour verbally recorded in legal documents, literary works and media texts reveals the universality and at the same time national specificity of traditions of peoples of different countries, manifested in discourse as an integrative field of knowledge.The promise to marry as a message about the obligation to marry and the promise as a performative speech act have linguocultural specificity, which is determined, among others, by communicative, factual and eventual, legal and value dominants, reflecting the national-linguistic picture of the world and cognitive representations of the people. The study of the main characteristics of the engagement ritual verbalized in different types of discourse and of the communicative act of promising to marry is performed in the context of discourse hermeneutics – a perspective branch of modern discoursology, which considers cultural-historical, social, philosophical, mental and linguistic characteristics when interpreting communicative units representing concepts and cultural phenomena.The authors have established dictionary meanings and peculiarities of the use of lexemes related to engagement, their similarities and differences in Russian- and Spanish-speaking cultural, linguistic and discursive environment. The review of legal regulation of engagement in Roman law, in the law of Russia, Spain, a number of countries of Latin America is carried out in order to reveal the national-cultural identity of the ritual, verbalized in the speech act of promise, and to find out the consequences of its non-fulfilment. The promise to marry in legal discourse is analysed from the position of speech act theory and the hypothesis that the speech acts performed during the engagement have the properties of performativity in those countries where the engagement retains legal consequences is confirmed. The moral and ethical meaning of the promise to marry and its non-fulfilment is also illustrated on the example of literary works.

Цель статьи заключается в проведении, впервые в испанистике, сквозь призму дискурсивного контекста (юридического, медийного и литературного) контрастивного анализа вербализации обряда помолвки и последствий её расторжения в русской, испанской и некоторых латиноамериканских культурах. Изучение взаимных соответствий и отличий ритуала обручения как социально ориентированной модели поведения, вербально зафиксированной в правовых документах, литературных произведениях и медийных текстах, раскрывает универсальность и одновременно национальную специфичность традиций народов разных стран, проявляющуюся в дискурсе как интегративной области знания.Обещание жениться как сообщение об обязательстве заключить брак и обещание как перформативный речевой акт обладают лингвокультурной спецификой, которая детерминируется, среди прочих, коммуникативными, фактуально-событийными, юридическими и ценностными доминантами, отражающими национально-языковую картину мира и когнитивные представления народа. Исследование ключевых характеристик ритуала помолвки, вербализированного в различных типах дискурса, и коммуникативного акта обещания жениться проводится в русле дискурсивной герменевтики – перспективного направления современной дискурсологии, учитывающего культурно-исторические, социальные, философские, ментальные и языковые характеристики при интерпретации коммуникативных единиц, репрезентирующих концепты и феномены культуры.Авторами установлены словарные значения и особенности использования лексем, связанных с помолвкой, их сходства и отличия в русскоязычной и испаноязычной культурно-языковой и дискурсивной среде. Осуществлён обзор нормативно-правового регулирования помолвки в римском праве, в праве России, Испании, ряда стран Латинской Америки с целью выявления национально-культурного своеобразия этого ритуала, вербализирующегося в речевом акте обещания, и установления последствий его неисполнения. Обещание жениться в юридическом дискурсе проанализировано с позиции теории речевых актов, и подтверждена гипотеза о том, что речевые акты, совершаемые в ходе помолвки, обладают свойствами перформативности в тех странах, где помолвка сохраняет правовые последствия. Также проиллюстрирован морально-нравственный смысл обещания жениться и его неисполнения на примере литературных произведений.

El artículo aborda el ritual de la promesa de matrimonio y las consecuencias de su disolución en el contexto de los discursos jurídico, mediático y literario. Los autores establecen la definición de los conceptos a base de los diccionarios de la Real Academia y determinan las características del uso de una serie de términos relacionados con el compromiso y la promesa de matrimonio en un entorno cultural y lingüístico de habla rusa e hispana. Se lleva a cabo una revisión de la regulación normativa de la promesa de matrimonio en el derecho romano, en el derecho de Rusia, España y algunos países de América Latina, con el objetivo de identificar la peculiaridad nacional-cultural de este ritual y establecer las consecuencias de su incumplimiento. Los autores analizan la promesa de matrimonio en el discurso jurídico desde los postulados de la teoría de los actos de habla y confirman la hipótesis de que en el discurso jurídico los actos de habla realizados a la hora de proponer matrimonio se efectúan como performativos en aquellos países donde el compromiso tiene consecuencias jurídicas. Los autores ilustran el significado moral y ético de la promesa matrimonio y su incumplimiento con el ejemplo de las obras literarias.
