Ustav Republike Hrvatske i pravo na privatnost

Abstract

Autorica polazi od činjenice da se u pravnom poretku Republike Hrvatske pravni temelj za zaštitu privatnosti nalazi u Ustavu Republike Hrvatske, temeljem kojega se svakom čovjeku i građaninu jamči štovanje i pravna zaštita osobnog i obiteljskog života, dostojanstva, ugleda i časti (čl.35.). Ustavom su zajamčeni različiti aspekti prava na privatnost, odnosno pravo na informacijsku privatnost (čl.37.) ili onaj aspekt privatnosti koji se odnosi na osobne podatke, pravo na komunikacijsku privatnost (čl-36.) ili onaj aspekt privatnosti koji se odnosi na dopisivanje i sve druge oblike općenja s drugim osobama, te pravo na prostornu privatnost (čl.34.) ili onaj aspekt privatnosti koji se odnosi na dom. Nakon analize relevantnih ustavnih jamstava i relevantnih zakonskih odredbi vezanih uz pravo na privatnost i zaštitu odnosnog prava, autorica dolazi do zaključka o stupnju zaštićenosti različitih aspekata prava na privatnost u našem zakonodavstvu, kao i o potencijalnim problemima u vezi odnosne problematike.
