Abstract
Dieser dritte Leitfaden der Reihe Grund- und Menschenrechte befasst sich mit dem Kindes- und Erwachsenenschutzrecht. Sozialarbeitende sind als Mitglieder einer Behörde, die Massnahmen anordnet, oder als Zuständige für deren Vollzug mit dafür verantwortlich, dass die Grund- und Menschenrechte der Betroffenen gewahrt werden. Das Kindes- und Erwachsenenschutzrecht bewegt sich an der Schnittstelle zwischen öffentlichem und privatem Recht. Es ist im Zivilgesetzbuch geregelt, enthält jedoch eine Vielzahl von Normen öffentlich-rechtlicher Natur, die eine Einschränkung der Rechte schutzbedürftiger Menschen ermöglichen oder erfordern. Der Staat hat die Pflicht, den Schutz von Kindern oder Erwachsenen, die nicht in der Lage sind, ihre Rechte selber wahrzunehmen, sicherzustellen. Gleichzeitig hat er die Aufgabe, ihnen weitestgehende Autonomie zu gewähren.Anhand von konkreten Fallbeispielen und Spannungsfeldern werden grundrechtskonforme Lösungsansätze aufgezeigt und so kann eine Brücke zur Praxis geschlagen werden. Fachpersonen und Behörden sollen dadurch unterstützt werden, in schwierigen Entscheidungssituationen grundrechtskonform zu handeln. Dieser Titel kann als gedrucktes Buch über den interact Verlag bezogen werden.
