CLÁUSULA ANTIABUSO VERSUS FRAUDE DE LEY: ¿DOS CONCEPTOS SEMEJANTES EN LA LEY GENERAL TRIBUTARIA?

Abstract

El presente trabajo pretende analizar el alcance y la naturaleza que ofrece la figura de la «cláusula antiabuso» o «conflicto en la aplicación de la norma» en la Ley 58/2003, de 17 de diciembre, General Tributaria, a través de un estudio comparativo de las condiciones necesarias para su aplicación en relación con aquéllas que tradicionalmente han caracterizado la proyección del fraude de ley en materia tributaria o las figuras de la simulación y de la economía de opción. Asimismo es objeto de debate, a la luz de importantes pronunciamientos de la jurisprudencia tales como la STC 120/2005, de 10 de mayo, la cuestión relativa a la aplicación de sanciones, administrativas o penales, en los supuestos de elusión tributaria o de fraude de ley.
