Abstract

يهدف هذا البحث إلى تجلية موقف المذهب الإباضي من المصلحة المرسلة من حيث التأصيل له دليلا أصوليا مع بحث تطبيقين فقهيين معاصرين، وقد استخدم الباحثان فيه المنهج الاستقرائي والوصفي والتحليلي والنقدي والمقارن. واحتوى أربعة محاور؛ الأول في مفهوم المصلحة المرسلة عند الإباضية والثاني في حجيتها، والثالث في ضوابطها والرابع في عرض تطبيقين فقهيين هما الإلزام بعقد التأمين وحماية حقوق المؤلف. وتوصل البحث لنتائج عديدة أهمها: أن المصلحة المرسلة دليل معتبر في المذهب الإباضي وإن لم يرد هذا المصطلح عند علماء القرون الثلاثة الأولى، واستدلوا لحجيتها بالسنة واستقراء نصوص الشريعة وأحكامها والإجماع، وأن إلزام الدولة الأفراد والمؤسسات بعقد التأمين، واعتبار حق المؤلف داخل في باب المصلحة المرسلة.
