Abstract

Contexto: O surgimento do metaverso traz novos desafios para o Direito, em especial pela predominância de ecossistemas digitais com amplo poder acerca da arquitetura de escolha do consumidor. Assim, o espaço virtual construído pelo metaverso faz com que as ferramentas da economia comportamental sejam essenciais para uma aplicação adequada das políticas de defesa da concorrência e de proteção consumidor. Objetivo: Apresentar como as principais características do metaverso impactam as abordagens tradicionais de defesa da concorrência e do consumidor e trazem a necessidade da utilização de ferramentas da economia comportamental. Método: Método dedutivo e de revisão bibliográfica. Conclusões: As especificidades do metaverso tornam essencial a incorporação do poder sobre a arquitetura da escolha do consumidor na análise concorrencial, que deve incluir os ferramentais da economia comportamental e continua sendo essencial para o controle do poder econômico e a defesa do consumidor.
