El Estado colombiano tiene una capacidad de sanción que ha sido diseñada para ser ejercida por el presidente de la república. En algunas ocasiones gracias a la figura de la delegación se les entregan estas facultades de sanción a los gobernadores, los alcaldes de los distritos y los alcaldes de los municipios, quienes actúan como representantes legales de estas entidades territoriales que hasta la fecha son las únicas que existen en Colombia. El presente trabajo evaluará esa capacidad de sanción en un tema especifico como es el procedimiento sancionatorio de alimentos, procedimiento que es similar en su estructura legal en todas las entidades territoriales, pero que en su aplicación presenta características diferentes, estas diferencias permiten demostrar la hipótesis planteada que los procedimientos sancionatorios en alimentos en las entidades territoriales son débiles, no obstante contar con toda la facultad sancionadora delegada para ejercer esta actividad. The Colombian state has a sanction capacity which has been create to be exerted by the president of the republic. Sometimes thanks to the figure of the delegation, those sanction faculties are delivered to the governors, to the mayors of the districts and also to the mayors of the municipalities, who act as legal representatives of the territorial entitles which are the unique that exist in Colombia. This task will evaluate the capacity of sanction on an specific topic as it is the sanctioning procedure of foods. Procedure that is similar in its legal structure to all the territorial entitles, but on its applications, it presents different characteristics. Those differences allow to demonstrate the proposed hypothesis which indicates that sanctioning procedures in foods and territorial entities are weak, However to count on the sanctioning faculty delegated to exert this assignment Keywords: intervention, procedure, sanction, sanctioning authority The Colombian State has the competency to sanction, which has been design to be executed by the President of the Republic. In some instances, thanks to the act of deputing, said competency to sanction is appointed to the department governors, districts mayor and municipal mayors, who act as legal representatives to these territorial entities, which to date, are the only ones in existence in Colombia. The present work will evaluate that competency to sanction in a specific topic such as the food sanctionative procedure, which in its legal structure is similar in all the territorial entities, yet in its execution exhibits different characteristics; these differences allow demonstrating the proposed hypothesis that the food.
