European Law – The lis pendens provisions of the Brussels Convention and anti-suit injunctions
The author examines, through a discussion of the BNFL case, the sort of procedural issues which are likely to occur when parallel proceedings ("dispute elsewhere pending") are being litigated in states which have adopted the Brussels convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters.
