Abstract

Este trabalho objetiva encontrar vias legítimas e adequadas para solucionar conflitos na era da intermediação eletrônica do trabalho, em especial existentes entre motoristas contratados pelo aplicativo da empresa Uber. A pesquisa realizada nesta dissertação envolveu acompanhamento do procedimento investigativo instaurado pelo Ministério Público do Trabalho, acerca de possíveis lesões aos direitos coletivos dos trabalhadores, bem como à ordem jurídica e o mapeamento das ações trabalhistas em curso nos Tribunais Regionais do Trabalho brasileiros. A presente dissertação visa também demonstrar as estratégias utilizadas pela empresa pesquisada para seduzir consumidores, clientes, trabalhadores e, inclusive, o Governo e o Poder Judiciário, o que acaba por dificultar, para não dizer inviabilizar, o acesso efetivo dos motoristas à Justiça e aos direitos trabalhistas.

This paper aims to find legitimate and adequate ways to solve conflicts in the era of electronic labor intermediation, especially among drivers hired by Uber. The research carried out in this dissertation involved the monitoring of the investigative procedure instituted by the Brazilian Public Prosecutor's Office, concerning possible injuries to the workers' collective rights, as well as to the legal order. The present dissertation also aims to demonstrate the strategies used by the company researched to seduce consumers, clients, workers and even the Government and the Judiciary, which makes it difficult, not to say unfeasible, to effectively access drivers to Justice and labor rights.
