Trest domácího vězení

Abstract

The rigorous work deals with the anchoring and history of the imprisonment, its position in the Czech Penal Code, the Probation and Mediation Service, including its role in the execution of the house arrest. Part of the work is focused on electronic monitoring, first in the Czech Republic and subsequently in other countries, where domestic prisons are dealt with in accordance with the legal regulations of the comparative countries. Part of the work is also devoted to case law and statistics. The thesis is supplemented by a practical part consisting of 2 studies, one being an interview with the head of the Probation and Mediation Service Center in Benesov Bc. Jitka Pohunková and the other interview with the prisoner of imprisonment in Benesov district.

Rigorózní práce pojednává o ukotvení a historii trestu domácího vězení, dále o jeho postavení v trestních předpisech České republiky, o probační a mediační službě včetně její úlohy při výkonu trestu domácího vězení. Část práce je zaměřena na elektronický monitoring, zprvu v České republice a následně i v ostatních zemích, kdy je rozebráno domácí vězení v souladu s právní úpravou komparovaných zemí. Jistý úsek práce je věnován i judikatuře a statistikám. Práce je doplněna i o praktickou část, která je složena ze 2 výzkumů, přičemž jedním je rozhovor s vedoucí střediska probační a mediační služby v Benešově Bc. Jitkou Pohunkovou a druhým pak rozhovor s odsouzeným k trestu domácího vězení na okrese Benešov.
