    Bolivia es un país diverso, con fuerte sello indígena de sus alrededor de 36 pueblos y una cultura dominante criolla hispánica. Estas culturas que fueron subordinadas y excluidas a partir de la conquista española y que lo continuarían siendo en las diferentes etapas de la vida republicana. Como resultado, la responsabilidad de su sobrevivencia se debió a sus autoridades y organizaciones tradicionales. El pueblo aymara, ha mantenido, conceptos y prácticas propios: de desarrollo como "vivir bien"; de organización basada en las prácticas democráticas del ayllu y de ciudadanía forjada como jaq'i (persona) dentro del servicio a la comunidad. Evo Morales sólo se puede entender si se analiza desde esta visión que viene de la memoria larga. Las prácticas y visiones indígenas emergen de la clandestinidad, a partir, de la puesta en práctica de una medida de segunda generación del modelo de ajuste estructural: la Ley de Participación Popular, propuesta para disminuir el descontento popular. La tesis revisa las lógicas andinas de desarrollo, democracia, participación y ciudadanía en la propuesta de participación y descentralización modernizadora impuesta. La recuperación de estos conceptos tiene como objetivo centrarlos en el conflicto de actores y en el proceso de construir una opción de desarrollo. El movimiento indígena boliviano, ha desarrollado un “imaginario colectivo” diferente a la lógica dominante y, puede dar ahora conceptos alternativos de desarrollo, democracia, ciudadanía y poder. Las consecuencias son evidentes: recuperación de la autoestima, valoración de la identidad, otra forma de gobernanza y en una visión alternativa de desarrollo, en el Vivir Bien. Y, no sólo para el contexto boliviano si no también para otros países en la América Latina. La investigación se ha centrado en cuatro municipios en el altiplano aymara, que históricamente pertenecen a uno de los señoríos aymaras, poderoso y conocido por la característica combativa de su población: el señorío Pakajaqi(los hombres águila). El proceso boliviano es, también una muestra interesante de que las reglas hegemónicas pueden dar otros resultados a los esperados por el sistema.     Neste artigo, propomos analisar o papel do conhecimento na acção pública, adoptando uma perspectiva que se afasta quer da ideia que o conhecimento é um mero instrumento nas mãos dos actores mais poderosos, quer, ao contrário, que é uma maneira eficaz de evitar a predominância dos interesses e das ideologias. O nosso quadro conceptual começa com a análise do conhecimento usado para colocar problemas ou apresentar recomendações no topo da agenda. A circulação desse conhecimento é entendida como sendo estruturada por circuitos de conhecimento, mais ou menos estáveis. Esses circuitos são vistos como um dos quatro factores que estruturam o que acontece em cada uma das cenas, várias e interligadas, que estão envolvidas no processo de acção pública. Este quadro teórico ajuda a analisar não só os estudos de caso específicos, mas também as variações do lugar ocupado pelo conhecimento, em função do tempo, dos países e dos sectores em que se exerce a acção pública.

    This report is based on desk and empirical research which applied methodological triangulation. The research included a field mission of six weeks in 2014, between May and June to Guatemala during which interviews and meetings with local, national and international key stakeholders were conducted. In coordination with the indigenous community authorities of the microregion Nimlaha'kok (Coban, Alta Verapaz province), located in the zone of influence of the Xalalá project, focus groups and meetings with indigenous authorities, elders and women were conducted to investigate their concerns and their perceptions of the right to consultation and other human rights at risk from the indigenous vision. This report examines first the historical and socio-political context of the Xalalá project, the resistance of indigenous communities Q'eqchi 'against the dam, the history and characteristics of the Q'eqchi' culture and the new Integral Management Model of the National Electrification Institute (INDE). Second, the national and international legal framework with regard to territorial and natural resource rights and the right to prior, free and informed consultation with indigenous peoples is discussed. Also, the principles, guidelines and policies with respect to business and financial institutions related to human rights and indigenous peoples are reviewed. The study also includes a legal anthropological analysis of several human rights that might be violated by the implementation of this project. Finally, the report makes several conclusions and formulates recommendations directed to the State of Guatemala, investors and the international cooperation. Este informe se basa en una investigación de escritorio y empírica que ha utilizado una triangulación metodológica. Entre ellos se realizó una misión de investigación de 6 semanas en 2014, entre mayo y junio, durante lo cual se mantuvieron entrevistas y reuniones con los actores clave locales, nacionales e internacionales. En coordinación con la autoridades comunitarias de la microregión Nimlaha’kok (Cobán, departamento de Alta Verapaz), que se encuentra en la zona de influencia del proyecto Xalalá, se realizó también grupos focales y reuniones con las autoridades indígenas, ancianos y mujeres para investigar sus preocupaciones y también sus percepciones sobre la consulta y los derechos potencialmente vulnerados desde su visión indígena. Este informe analiza primero los antecedentes históricos y socio-políticos del proyecto hidroeléctrico Xalalá, la resistencia de las comunidades indígenas q’eqchi’ contra esta represa, la historia y las características del pueblo q’eqchi’ y el nuevo Modelo de Gestión Integral del INDE acerca de este proyecto. Se discute también el marco jurídico tanto nacional como internacional con respecto a los derechos territoriales y de los recursos naturales y el derecho a la consulta previa, libre e informada de los pueblos indígenas. Asimismo, se revisan los principios, directrices y políticas con respecto a empresas y organismos financieros relacionados a derechos humanos y pueblos indígenas. Después se realiza un análisis antropológico-jurídico de varios derechos humanos que serán vulnerados por la implementación del proyecto Xalalá. Finalmente, el informe formula una serie de conclusiones y recomendaciones dirigidas al Estado de Guatemala, a los inversionistas y a la cooperación internacional.

    Desde el acuerdo comercial UE-Corea, que entró en vigor en 2011, todos los capítulos sobre comercio y desarrollo sostenible contemplan mecanismos de la sociedad civil para la supervisión de los compromisos recogidos en dichos capítulos: un grupo consultivo interno (GCI) para cada parte y una reunión transnacional anual de la sociedad civil. El primero es un mecanismo cerrado basado en sus miembros, mientras que el segundo no se basa en sus miembros y, por lo tanto, es más abierto y menos estructurado que los GCI. Este informe se centra en los GCI, los órganos de la sociedad civil más institucionalizados y permanentes contemplados en los capítulos sobre comercio y desarrollo sostenible. El objetivo de este estudio es realizar una evaluación exhaustiva de los GCI, determinar sus principales problemas, distinguir entre las dificultades iniciales y los problemas estructurales, y proponer soluciones para resolverlos. Los datos se recopilaron a través de un cuestionario que contestaron 50 miembros de GCI de la UE y 74 miembros de GCI que no pertenecen a la UE, así como a través de 18 entrevistas a miembros de GCI de la UE y de fuera de la UE.

Las consecuencias son evidentes: recuperación de la autoestima, valoración de la identidad, otra forma de gobernanza y en una visión alternativa de desarrollo, en el Vivir Bien. Y, no sólo para el contexto boliviano si no también para otros países en la América Latina. La investigación se ha centrado en cuatro municipios en el altiplano aymara, que históricamente pertenecen a uno de los señoríos aymaras, poderoso y conocido por la característica combativa de su población: el señorío Pakajaqi(los hombres águila). El proceso boliviano es, también una muestra interesante de que las reglas hegemónicas pueden dar otros resultados a los esperados por el sistema.     Neste artigo, propomos analisar o papel do conhecimento na acção pública, adoptando uma perspectiva que se afasta quer da ideia que o conhecimento é um mero instrumento nas mãos dos actores mais poderosos, quer, ao contrário, que é uma maneira eficaz de evitar a predominância dos interesses e das ideologias. O nosso quadro conceptual começa com a análise do conhecimento usado para colocar problemas ou apresentar recomendações no topo da agenda. A circulação desse conhecimento é entendida como sendo estruturada por circuitos de conhecimento, mais ou menos estáveis. Esses circuitos são vistos como um dos quatro factores que estruturam o que acontece em cada uma das cenas, várias e interligadas, que estão envolvidas no processo de acção pública. Este quadro teórico ajuda a analisar não só os estudos de caso específicos, mas também as variações do lugar ocupado pelo conhecimento, em função do tempo, dos países e dos sectores em que se exerce a acção pública.

    This report is based on desk and empirical research which applied methodological triangulation. The research included a field mission of six weeks in 2014, between May and June to Guatemala during which interviews and meetings with local, national and international key stakeholders were conducted. In coordination with the indigenous community authorities of the microregion Nimlaha'kok (Coban, Alta Verapaz province), located in the zone of influence of the Xalalá project, focus groups and meetings with indigenous authorities, elders and women were conducted to investigate their concerns and their perceptions of the right to consultation and other human rights at risk from the indigenous vision. This report examines first the historical and socio-political context of the Xalalá project, the resistance of indigenous communities Q'eqchi 'against the dam, the history and characteristics of the Q'eqchi' culture and the new Integral Management Model of the National Electrification Institute (INDE). Second, the national and international legal framework with regard to territorial and natural resource rights and the right to prior, free and informed consultation with indigenous peoples is discussed. Also, the principles, guidelines and policies with respect to business and financial institutions related to human rights and indigenous peoples are reviewed. The study also includes a legal anthropological analysis of several human rights that might be violated by the implementation of this project. Finally, the report makes several conclusions and formulates recommendations directed to the State of Guatemala, investors and the international cooperation. Este informe se basa en una investigación de escritorio y empírica que ha utilizado una triangulación metodológica. Entre ellos se realizó una misión de investigación de 6 semanas en 2014, entre mayo y junio, durante lo cual se mantuvieron entrevistas y reuniones con los actores clave locales, nacionales e internacionales. En coordinación con la autoridades comunitarias de la microregión Nimlaha’kok (Cobán, departamento de Alta Verapaz), que se encuentra en la zona de influencia del proyecto Xalalá, se realizó también grupos focales y reuniones con las autoridades indígenas, ancianos y mujeres para investigar sus preocupaciones y también sus percepciones sobre la consulta y los derechos potencialmente vulnerados desde su visión indígena. Este informe analiza primero los antecedentes históricos y socio-políticos del proyecto hidroeléctrico Xalalá, la resistencia de las comunidades indígenas q’eqchi’ contra esta represa, la historia y las características del pueblo q’eqchi’ y el nuevo Modelo de Gestión Integral del INDE acerca de este proyecto. Se discute también el marco jurídico tanto nacional como internacional con respecto a los derechos territoriales y de los recursos naturales y el derecho a la consulta previa, libre e informada de los pueblos indígenas. Asimismo, se revisan los principios, directrices y políticas con respecto a empresas y organismos financieros relacionados a derechos humanos y pueblos indígenas. Después se realiza un análisis antropológico-jurídico de varios derechos humanos que serán vulnerados por la implementación del proyecto Xalalá. Finalmente, el informe formula una serie de conclusiones y recomendaciones dirigidas al Estado de Guatemala, a los inversionistas y a la cooperación internacional.

    Desde el acuerdo comercial UE-Corea, que entró en vigor en 2011, todos los capítulos sobre comercio y desarrollo sostenible contemplan mecanismos de la sociedad civil para la supervisión de los compromisos recogidos en dichos capítulos: un grupo consultivo interno (GCI) para cada parte y una reunión transnacional anual de la sociedad civil. El primero es un mecanismo cerrado basado en sus miembros, mientras que el segundo no se basa en sus miembros y, por lo tanto, es más abierto y menos estructurado que los GCI. Este informe se centra en los GCI, los órganos de la sociedad civil más institucionalizados y permanentes contemplados en los capítulos sobre comercio y desarrollo sostenible. El objetivo de este estudio es realizar una evaluación exhaustiva de los GCI, determinar sus principales problemas, distinguir entre las dificultades iniciales y los problemas estructurales, y proponer soluciones para resolverlos. Los datos se recopilaron a través de un cuestionario que contestaron 50 miembros de GCI de la UE y 74 miembros de GCI que no pertenecen a la UE, así como a través de 18 entrevistas a miembros de GCI de la UE y de fuera de la UE.
