    El rascacielos ha sido uno de los tipos arquitectónicos emblemáticos del siglo XX; su imagen está asociada con la idea de progreso, avances tecnológicos y poder corporativo. Frente a los cambios propios de la contemporaneidad, ¿este tipo arquitectónico sigue vigente en la actualidad? Si es así, ¿cómo debería ser el rascacielos del siglo XXI?. Posibles respuestas a estas cuestiones las encontramos en eVolo Skyscraper Competition, que desde 2006 y con la consigna “Estudiar, desarrollar, evolucionar, volar”, invita anualmente a arquitectos, ingenieros, diseñadores y artistas de todo el mundo para que justamente propongan ideas novedosas sobre estos edificios verticales. Este artículo propone el análisis de las características del concurso y el establecimiento en el mismo de una posible agenda de las cuestiones relevantes de la disciplina en la actualidad.     La reforma constitucional de 1994 en Argentina incorporó el Consejo de la Magistratura para mejorar las dimensiones de la idoneidad e independencia judicial en la selección de jueces inferiores a nivel federal. Sin embargo, persisten problemas de falta de transparencia e influencia política, demora en los concursos, ausencia de diversidad y una discrecionalidad fuerte en ciertas etapas del proceso de selección. Este artículo indaga la posibilidad de que la inteligencia artificial (IA) contribuya a mejorar algunos de estos problemas, mediante la automatización del análisis de antecedentes, la evaluación de exámenes y la gestión de datos, reduciendo la discrecionalidad y los sesgos humanos. Aunque la IA puede ofrecer beneficios significativos, presenta desafíos éticos y técnicos, como la perpetuación de sesgos algorítmicos y la desconfianza en los procesos automatizados, por lo que su implementación debe ser cuidadosamente gestionada. The 1994 constitutional reform in Argentina incorporated the Judicial Council to improve the dimensions of judicial suitability and independence in the selection of lower judges at the federal level. However, problems persist with a lack of transparency and political influence, delays in competitions, lack of diversity, and strong discretion at certain stages of the selection process. This article explores the possibility that artificial intelligence (AI) can help improve some of these problems, through the automation of background analysis, exam evaluation and data management, reducing human discretion and bias. Although AI can offer significant benefits, it presents ethical and technical challenges, such as the perpetuation of algorithmic biases and distrust in automated processes, so its implementation must be carefully managed.     Este trabajo analiza la interacción entre derecho y política internacionales desde el surgimiento de los Estados, sus interferencias y contradicciones. En esa percepción se considera la efectividad del “orden” de Westfalia, que acomodó la vida internacional en función del equilibrio de poderes, manifestado incluso en el sistema de Naciones Unidas. Siendo el Estado y el derecho internacional creación europea, se expondrá la necesidad de nuevas “reglas de juego” para superar aquel viejo esquema etnocéntrico con uno acorde a una fase geopolítica multipolar. Se centrará la atención en los principios de derecho internacional, la cuestión de su fragmentación y del softlaw. Se abordará también el cambiante derrotero de la recepción del derecho internacional en el derecho interno argentino, y el papel que tuvo al respecto la Corte Suprema de Justicia de la Nación antes de la reforma de 1994. Por último, se presentarán algunas conclusiones provisorias. This work analyzes the interaction between international law and politics since the emergence of States, their interferences and contradictions. Under this perception, the effectiveness of the Westphalian “order” is considered, which accommodated international life according to the balance of powers, manifested even in the United Nations system. Since the State and international law are European creations, the need for new “rules of the game” will be presented to overcome that old ethnocentric scheme with one in line with a multipolar geopolitical phase. Attention will focus on the principles of international law, the issue of its fragmentation and softlaw. The changing course of the reception of international law in Argentine domestic law will also be addressed, and the role that the Supreme Court of Justice of the Nation had in this regard before the 1994 reform.     En Argentina, el habeas data está garantizado por el artículo 43 de la Constitución nacional, incorporado en la reforma de 1994. La inclusión de esta cláusula en la Constitución nacional ha generado ciertas controversias que han sido superadas con la sanción de la Ley de Protección de Datos Personales 25326. En la actualidad, sin embargo, surgen nuevos cuestionamientos que exigen una revisión del instituto. La revolución digital, en particular, ha transformado la forma en que se recopilan, procesan y comparten los datos personales. Por eso, el derecho debe adaptarse a esta nueva realidad y brindar respuestas adecuadas que garanticen la protección de la privacidad y la seguridad de las personas. Las bases sobre las cuales se erigió el instituto del habeas data comienzan a tambalear y reclaman, de manera imperativa, un marco normativo que brinde soluciones a los problemas contemporáneos. En este artículo se analizará cada una de las etapas del instituto del habeas data. En primer lugar, se evaluará la labor de la Convención Constituyente; en segundo lugar, se abordará la cuestión sobre su reglamentación; luego, se desarrollarán las cuestiones procesales de aquel; y finalmente se examinará la protección de los datos personales en la era digital. De este modo, no se busca analizar el habeas data como un instituto anclado en el tiempo sino como uno en constante desarrollo, que adquiere aún más relevancia con la consolidación de la sociedad de la información. This analysis of the judgement “C, A. M s/ Precautionary measures Family” file 86054/2017 of the Chamber E of the Civil National Court (June 7, 2021) proposes to consider whether it is possible to prioritize legal formal requirements — such as the prior registration in the Registry of Applicants for Guardianship with Purposes of Adoption — over over the emotional reality of a child. Specifically, in the case under study, the possibility for a foster family bein as such as the best interest of the child and the right of every human being for the State to respect and protec his or her family. This is a social unit, the family, which originates from an emotional reality and precedes its legal recognition. The Supreme Court of Buenos Aires has already stated that “(...) if the child is instrumentalized to preserve a supposed intangibility of the order established by the Registry, the values are inverted, consecrating the superior interest of the Registry, not of the child”.     En la última década, en la Provincia de Salta (Noroeste Argentino) se han generado múltiples instrumentos de planificación territorial de escala provincial, metropolitana y municipal. De acuerdo a los resultados de la investigación, la mayor parte de esos instrumentos no se han reflejado en impactos territoriales concretos y tangibles. Por el contrario, se han intensificado y profundizado los conflictos de insustentabilidad urbana y territorial, especialmente en el ámbito geográfico sobre el que se focaliza el proyecto, el Área Metropolitana del Valle de Lerma. El estudio identifica como causa raíz de esta situación la debilidad de capacidades institucionales de los organismos responsables de la gestión territorial, por lo cual incluye contenidos propositivos orientados a la conformación de un Sistema Integrado de Gestión Territorial, basado en programas de mejora continua y la utilización de Indicadores Críticos de Desempeño, que facilite la materialización del Modelo Territorial sostenible planteado en el proyecto.     En oportunidad de rendir homenaje a nuestro plexo jurídico de base por los treinta años desde su última reforma, consideramos abordar en este artículo el tema de los tratados internacionales de derechos humanos que han sido incorporados a nuestro derecho positivo interno mediante el artículo 75 inciso 22 y la correspondiente protección multinivel de los derechos fundamentales dentro del Sistema Interamericano de Protección de los Derechos Humanos. Con motivo de situaciones de conflicto que genera el comportamiento de los justiciables, que deben ser juzgadas en el ámbito de los Estados adheridos a diversos pactos internacionales, han surgido en los últimos tiempos dificultades para dilucidar quiénes son los jueces que deben intervenir en última instancia para resolver tales controversias. La complejidad reside en que dichos Estados, al tiempo del juzgamiento, se amparan, muchas veces, en normas de orden interno que hacen a la denominada “identidad constitucional” del Estado. Ahora bien, el problema se suscita cuando esa denominada “identidad” entra en conflicto con principios volcados en el tratado, pero también cuando existen controversias acerca de cuál es el órgano que debe resolver esa cuestión, de tal manera de validar la decisión en el ámbito interno de cada nación y en el ámbito de la comunidad internacional a la que pertenece. On the occasion of paying tribute to our basic legal plexu for the thirty years since its last reform, we consider addressing in this article the issue of international human rights treaties that have been incorporated into our domestic positive law through article 75, paragraph 22. and the corresponding multilevel protection of fundamental rights within the interAmerican system. Due to conflict situations generated by the behavior of defendants, which must be judged within the scope of the States adhering to various international agreements, difficulties have arisen in recent times to clarify who are the judges who must intervene in the last instance to resolve such disputes. The complexity lies in the fact that these States, at the time of the trial, often rely on internal regulations that make up the socalled “constitutional identity” of the State. However, the problem arises when this so-called “identity” comes into conflict with principles included in the treaty, but also when there are disputes as to which is the body that should resolve that issue, in such a way as to validate the decision within the internal sphere of each nation and in the scope of the international community to which it belongs.     La reciente divulgación sobre los estudios y las exposiciones organizadas sobre el ruralismo realizadas por AMO ha reavivado los debates sobre las lógicas de urbanización y los medios para la construcción de un paisaje más cercano a la naturaleza. En este trabajo tomaremos de ejemplo lo sucedido durante fines del siglo XIX y principios del siglo XX, entendiendo tal época como el momento de mayor crisis para el desarrollo de las ciudades y de las urbanizaciones industriales-capitalistas posterior al cambio de paradigma que significó la creación del motor de combustión interna, con sus consecuentes migraciones urbanas. Las oportunidades laborales que motivaron dichas migraciones se transformaron en formación de tugurios y hacinamientos peligrosos para la salubridad general, lo que generó la formación de numerosas crisis sociales que se verían paulatinamente reposadas por un principal instrumento: la vivienda obrera. De esta manera, ahondaremos las relaciones entre la vivienda obrera con los diversos estilos y tipos arquitectónicos, y, a su vez, la construcción de imaginarios urbanos como resistencia al avance de la modernización. Esta revisión de nuestro pasado urbano, a partir de las semejanzas con los debates contemporáneos, creemos que nos brindaran herramientas incuestionables para la resolución y el análisis de nuestro futuro.     La ciudad de Medellín en su configuración rural cuenta con 5 corregimientos, Santa Elena, San Sebastián de Palmitas, San Antonio de Prado, Altavista y San Cristóbal y su estructura urbana se concentra en la ciudad de Medellín. De esta zona de estudio se pretende evidenciar la selección, aplicación e interpretación de las variaciones en los patrones de ordenamiento y la estructura espacial del paisaje del área de Medellín durante los últimos 40 años. Dicho planteamiento busca responder a la pregunta ¿Cuáles son las variaciones en los patrones de ordenamiento y la estructura espacial del paisaje en el área de Medellín, que permiten identificar medidas de actuación y conservación de los servicios ecosistémicos del paisaje en la ciudad? Para ello, ha sido necesario la exploración y combinación de herramientas digitales, geomática, teledetección y de fotogrametría digital, que permiten desde diferentes posibilidades gráficas, analizar elementos del paisaje y sus dinámicas, así como el estudio detallado de los usos del suelo para su valoración y contraste. El geoprocesamiento realizado a las imágenes satelitales obtenidas para cualificar y cuantificar los usos del suelo, ha permitido apreciar el paisaje de Medellín desde la óptica espacial, arrojando imágenes llamativas, excepcionales y artísticas que tienen un propósito técnico, comunicativo y estético. El análisis espacial cualitativo estuvo dividido en cinco partes para detallar la estructura: territorio, región, lugar, ubicación y paisaje, esto permitió obtener una primera imagen de la estructura del paisaje o unidad visual de paisaje (UVP) y su constitución. La cuantificación formal del paisaje fue dada por índices, como el Índice de área, densidad y variabilidad; Índices de forma; Índices de ecotono y hábitat interior; Índices de distancia, vecindad y conectividad, y el Índice de diversidad del paisaje.     Este trabajo se centra en la identificación, descripción y análisis de las construcciones argumentales elaboradas por la Corte Interamericana de Derechos Humanos en torno al control de convencionalidad. Entre otros aspectos, se analizará el desarrollo que de esta práctica y sus notas distintivas realiza el Tribunal desde el año 2012 al 2020. El tema se enmarca en el control de convencionalidad aplicado por el Poder Ejecutivo en el ejercicio de la función administrativa; pero, centralmente, pretende visibilizar el acto administrativo inconvencional como efecto. Como problema, se advierte que el control de convencionalidad en contadas ocasiones constituye una práctica diaria en la interpretación del derecho doméstico en el ámbito del referido poder público. En efecto, una de las causas que envuelve a esta problemática obedece a que los casos son resueltos al amparo de la Constitución y de la ley, pero se pasa por alto que el principio de juridicidad en sede administrativa se ve ampliado a partir de la jerarquización de los tratados internacionales de derechos humanos. This work focuses on the identification, descrip tion and analysis of the argumentative constructions developed by the Inter-American Court of Human Rights around the control of conventionality. Among other aspects, the development of this practice and its distinctive notes made by the court from 2012 to 20201 will be analyzed. The topic is framed in the control of conventionality applied by the Executive Branch in the exercise of the administrative function but, centrally, it aims to make visible the unconventional administrative act as an effect. As a problem, it is noted that conventionality control rarely constitutes a daily practice in the interpretation of domestic law in the scope of the aforementioned public power. In fact, one of the causes of this problem is that cases are resolved under the protection of the Constitution and the law, but it is overlooked that the principle of legality in administrative headquarters is expanded from the hierarchization of international human rights treaties. Based on the above, the objective of this work is not to stop at analyzing the causes that motivate the little use of conventionality control at administrative headquarters but to start from the beginning, that is, to affirm that from the regulatory and jurispru dential point of view the Public Administration bodies are obliged to carry out a conventionality control in the exercise of the administrative function. In other words, it should be a daily practice for each sector to determine whether or not the norm that is being reviewed complies with what is determined by the American Convention on Human Rights or with the interpretation made by the Inter-American Court.     El rascacielos ha sido uno de los tipos arquitectónicos emblemáticos del siglo XX; su imagen está asociada con la idea de progreso, avances tecnológicos y poder corporativo. Frente a los cambios propios de la contemporaneidad, ¿este tipo arquitectónico sigue vigente en la actualidad? Si es así, ¿cómo debería ser el rascacielos del siglo XXI?.     La reforma constitucional de 1994 en Argentina incorporó el Consejo de la Magistratura para mejorar las dimensiones de la idoneidad e independencia judicial en la selección de jueces inferiores a nivel federal. Sin embargo, persisten problemas de falta de transparencia e influencia política, demora en los concursos, ausencia de diversidad y una discrecionalidad fuerte en ciertas etapas del proceso de selección. Este artículo indaga la posibilidad de que la inteligencia artificial (IA) contribuya a mejorar algunos de estos problemas, mediante la automatización del análisis de antecedentes, la evaluación de exámenes y la gestión de datos, reduciendo la discrecionalidad y los sesgos humanos. Aunque la IA puede ofrecer beneficios significativos, presenta desafíos éticos y técnicos, como la perpetuación de sesgos algorítmicos y la desconfianza en los procesos automatizados, por lo que su implementación debe ser cuidadosamente gestionada. The 1994 constitutional reform in Argentina incorporated the Judicial Council to improve the dimensions of judicial suitability and independence in the selection of lower judges at the federal level. However, problems persist with a lack of transparency and political influence, delays in competitions, lack of diversity, and strong discretion at certain stages of the selection process. This article explores the possibility that artificial intelligence (AI) can help improve some of these problems, through the automation of background analysis, exam evaluation and data management, reducing human discretion and bias. Although AI can offer significant benefits, it presents ethical and technical challenges, such as the perpetuation of algorithmic biases and distrust in automated processes, so its implementation must be carefully managed.     Este trabajo analiza la interacción entre derecho y política internacionales desde el surgimiento de los Estados, sus interferencias y contradicciones. En esa percepción se considera la efectividad del “orden” de Westfalia, que acomodó la vida internacional en función del equilibrio de poderes, manifestado incluso en el sistema de Naciones Unidas. Siendo el Estado y el derecho internacional creación europea, se expondrá la necesidad de nuevas “reglas de juego” para superar aquel viejo esquema etnocéntrico con uno acorde a una fase geopolítica multipolar. Se centrará la atención en los principios de derecho internacional, la cuestión de su fragmentación y del softlaw. Se abordará también el cambiante derrotero de la recepción del derecho internacional en el derecho interno argentino, y el papel que tuvo al respecto la Corte Suprema de Justicia de la Nación antes de la reforma de 1994. Por último, se presentarán algunas conclusiones provisorias. This work analyzes the interaction between international law and politics since the emergence of States, their interferences and contradictions. Under this perception, the effectiveness of the Westphalian “order” is considered, which accommodated international life according to the balance of powers, manifested even in the United Nations system. Since the State and international law are European creations, the need for new “rules of the game” will be presented to overcome that old ethnocentric scheme with one in line with a multipolar geopolitical phase. Attention will focus on the principles of international law, the issue of its fragmentation and softlaw. The changing course of the reception of international law in Argentine domestic law will also be addressed, and the role that the Supreme Court of Justice of the Nation had in this regard before the 1994 reform.     En Argentina, el habeas data está garantizado por el artículo 43 de la Constitución nacional, incorporado en la reforma de 1994. La inclusión de esta cláusula en la Constitución nacional ha generado ciertas controversias que han sido superadas con la sanción de la Ley de Protección de Datos Personales 25326. En la actualidad, sin embargo, surgen nuevos cuestionamientos que exigen una revisión del instituto. La revolución digital, en particular, ha transformado la forma en que se recopilan, procesan y comparten los datos personales. Por eso, el derecho debe adaptarse a esta nueva realidad y brindar respuestas adecuadas que garanticen la protección de la privacidad y la seguridad de las personas. Las bases sobre las cuales se erigió el instituto del habeas data comienzan a tambalear y reclaman, de manera imperativa, un marco normativo que brinde soluciones a los problemas contemporáneos. En este artículo se analizará cada una de las etapas del instituto del habeas data. En primer lugar, se evaluará la labor de la Convención Constituyente; en segundo lugar, se abordará la cuestión sobre su reglamentación; luego, se desarrollarán las cuestiones procesales de aquel; y finalmente se examinará la protección de los datos personales en la era digital. De este modo, no se busca analizar el habeas data como un instituto anclado en el tiempo sino como uno en constante desarrollo, que adquiere aún más relevancia con la consolidación de la sociedad de la información. This analysis of the judgement “C, A. M s/ Precautionary measures Family” file 86054/2017 of the Chamber E of the Civil National Court (June 7, 2021) proposes to consider whether it is possible to prioritize legal formal requirements — such as the prior registration in the Registry of Applicants for Guardianship with Purposes of Adoption — over over the emotional reality of a child. Specifically, in the case under study, the possibility for a foster family bein as such as the best interest of the child and the right of every human being for the State to respect and protec his or her family. This is a social unit, the family, which originates from an emotional reality and precedes its legal recognition. The Supreme Court of Buenos Aires has already stated that “(...) if the child is instrumentalized to preserve a supposed intangibility of the order established by the Registry, the values are inverted, consecrating the superior interest of the Registry, not of the child”.     En la última década, en la Provincia de Salta (Noroeste Argentino) se han generado múltiples instrumentos de planificación territorial de escala provincial, metropolitana y municipal. De acuerdo a los resultados de la investigación, la mayor parte de esos instrumentos no se han reflejado en impactos territoriales concretos y tangibles. Por el contrario, se han intensificado y profundizado los conflictos de insustentabilidad urbana y territorial, especialmente en el ámbito geográfico sobre el que se focaliza el proyecto, el Área Metropolitana del Valle de Lerma. El estudio identifica como causa raíz de esta situación la debilidad de capacidades institucionales de los organismos responsables de la gestión territorial, por lo cual incluye contenidos propositivos orientados a la conformación de un Sistema Integrado de Gestión Territorial, basado en programas de mejora continua y la utilización de Indicadores Críticos de Desempeño, que facilite la materialización del Modelo Territorial sostenible planteado en el proyecto.     En oportunidad de rendir homenaje a nuestro plexo jurídico de base por los treinta años desde su última reforma, consideramos abordar en este artículo el tema de los tratados internacionales de derechos humanos que han sido incorporados a nuestro derecho positivo interno mediante el artículo 75 inciso 22 y la correspondiente protección multinivel de los derechos fundamentales dentro del Sistema Interamericano de Protección de los Derechos Humanos. Con motivo de situaciones de conflicto que genera el comportamiento de los justiciables, que deben ser juzgadas en el ámbito de los Estados adheridos a diversos pactos internacionales, han surgido en los últimos tiempos dificultades para dilucidar quiénes son los jueces que deben intervenir en última instancia para resolver tales controversias. La complejidad reside en que dichos Estados, al tiempo del juzgamiento, se amparan, muchas veces, en normas de orden interno que hacen a la denominada “identidad constitucional” del Estado. Ahora bien, el problema se suscita cuando esa denominada “identidad” entra en conflicto con principios volcados en el tratado, pero también cuando existen controversias acerca de cuál es el órgano que debe resolver esa cuestión, de tal manera de validar la decisión en el ámbito interno de cada nación y en el ámbito de la comunidad internacional a la que pertenece. On the occasion of paying tribute to our basic legal plexu for the thirty years since its last reform, we consider addressing in this article the issue of international human rights treaties that have been incorporated into our domestic positive law through article 75, paragraph 22. and the corresponding multilevel protection of fundamental rights within the interAmerican system. Due to conflict situations generated by the behavior of defendants, which must be judged within the scope of the States adhering to various international agreements, difficulties have arisen in recent times to clarify who are the judges who must intervene in the last instance to resolve such disputes. The complexity lies in the fact that these States, at the time of the trial, often rely on internal regulations that make up the socalled “constitutional identity” of the State. However, the problem arises when this so-called “identity” comes into conflict with principles included in the treaty, but also when there are disputes as to which is the body that should resolve that issue, in such a way as to validate the decision within the internal sphere of each nation and in the scope of the international community to which it belongs.     La reciente divulgación sobre los estudios y las exposiciones organizadas sobre el ruralismo realizadas por AMO ha reavivado los debates sobre las lógicas de urbanización y los medios para la construcción de un paisaje más cercano a la naturaleza. En este trabajo tomaremos de ejemplo lo sucedido durante fines del siglo XIX y principios del siglo XX, entendiendo tal época como el momento de mayor crisis para el desarrollo de las ciudades y de las urbanizaciones industriales-capitalistas posterior al cambio de paradigma que significó la creación del motor de combustión interna, con sus consecuentes migraciones urbanas. Las oportunidades laborales que motivaron dichas migraciones se transformaron en formación de tugurios y hacinamientos peligrosos para la salubridad general, lo que generó la formación de numerosas crisis sociales que se verían paulatinamente reposadas por un principal instrumento: la vivienda obrera. De esta manera, ahondaremos las relaciones entre la vivienda obrera con los diversos estilos y tipos arquitectónicos, y, a su vez, la construcción de imaginarios urbanos como resistencia al avance de la modernización. Esta revisión de nuestro pasado urbano, a partir de las semejanzas con los debates contemporáneos, creemos que nos brindaran herramientas incuestionables para la resolución y el análisis de nuestro futuro.
