    Authors: Haničar, Elizabeta;

    Throughout our lives, we go through numerous changes. These changes are called transitions and are an integral part of our lives. Most of them are experienced as stressful. One of the first transitions a child encounters is entering kindergarten. Children with developmental difficulties are often exposed to a higher number of transitions that disrupt established routines and lead to changes in behavior. This is even more pronounced in children diagnosed with autism spectrum disorder due to the specific nature of the diagnosis. This paper presents a case study of a boy diagnosed with autism spectrum disorder in the process of transitioning from a Special Education Program for children with autism spectrum disorder in early and preschool age from the Center for Autism to a regular kindergarten group. The aim of this study is to design, implement and evaluate a transition program for a child with a diagnosis of autism spectrum disorder and other participants in the transition process. The transition process lasted for 8 months. Expert support was provided in the kindergarten group at the Center for Autism - preparation for transition and at Zvončić Kindergarten - the actual transition process and support after the transition. The progress of the boy was monitored at two time points - initial and final. The entire transition process was also evaluated. Based on the results obtained, guidelines and protocols for the transition were developed for the child, parents, educators, and peers. Svi mi tijekom život prolazimo kroz brojne promjene. Te promjene nazivaju se tranzicije i sastavni su dio našega života. Većinu njih doživljavamo kao stresne. Među prvim tranzicijama s kojima se dijete susreće je ona u dječji vrtić. Djeca s teškoćama u razvoju nerijetko su izložena većem broju tranzicija koje narušavaju uspostavljane rutine i dovode do promjene u ponašanju. Prethodno spomenuto još više dolazi do izražaja kod djece s dijagnozom poremećaj iz spektra autizma zbog specifičnosti same dijagnoze. U radu je prikaz slučaja dječaka s dijagnozom poremećaj iz spektra autizma u procesu tranzicije iz Posebnog odgojno-obrazovnog programa za djecu s poremećajem iz spektra autizma rane i predškolske dobi pri Centru za autizam u redovnu vrtićku skupinu. Cilj ovog rada je osmisliti, provesti i vrednovati tranzicijski program za dijete s dijagnozom poremećaj iz spektra autizma i ostale dionike procesa tranzicije. Proces tranzicije trajao je 8 mjeseci. Stručna podrška provodila se u vrtićkoj skupini u Centru za autizam – priprema za tranziciju i u Dječjem vrtiću Zvončić - sam proces tranzicija i podrška nakon tranzicije. Napredak dječaka praćen je u dvije vremenske točke – inicijalna i finalna. Također se vrednovao cijeli proces tranzicije. Temeljem dobivenih rezultata izrađene su smjernice i protokoli za tranziciju za dijete, roditelje, odgojitelje i vršnjake.

    Stupanjem na snagu novog Kaznenog zakona 1. siječnja 2013. godine izmijenjen je koncept kaznenih djela protiv spolne slobode uvođenjem kaznenog djela spolnog odnošaja bez pristanka, posebno kažnjavanje u slučaju postojanja otklonjive zablude u odnosu na pristanak te je dana zakonska definicija pristanka kao i kada se smatra da takvog pristanka nema. Stupanje na snagu tog zakona izazvalo je brojne teorijske i praktične probleme. Zakonodavac je u ovoj glavi napravio još jednu izmjenu i to 2019. godine kada je kazneno djelo spolnog odnošaja bez pristanka brisano i postalo je stavak 1. kaznenog djela silovanja iz članka 153. U radu je iznesen pregled kaznenih djela protiv spolne slobode i njihov razvoj u Republici Hrvatskoj, razlozi za uvođenje u Kazneni zakon posebnog kaznenog djela spolnog odnošaja bez pristanka i nakon toga za njegovo brisanje. Analizirana je zakonska definicija pristanka na spolni odnošaj i s njim izjednačenu spolnu radnju, kada se prema zakonu smatra da takvog pristanka nema kao i uvedeno kažnjavanje počinitelja koji je bio u otklonjivoj zabludi o postojanju pristanka. Uz svako zakonsko rješenje izneseni su u literaturi uočeni teorijski i praktični problemi i njihovo moguće rješavanje kao i sudska praksa u razdoblju od 2011. godine do danas. Prilikom istraživanja za potrebe rada analizirano je 238 presuda koje se odnose na kazneno djelo silovanja i 100 presuda koje se odnose na kazneno djelo spolnog odnošaja bez pristanka (odnosno temeljno kazneno djelo silovanja nakon izmjene Kaznenog zakona iz 2019. godine) svih sudova u Republici Hrvatskoj. Izneseni su u praksi uočeni problemi u odnosu na razgraničenje temeljnog kaznenog djela silovanja (ranije kaznenog djela spolnog odnošaja bez pristanka) i kvalificiranog kaznenog djela silovanja. S obzirom na izmijenjeni koncept kaznenih djela protiv spolne slobode i izmjene Kaznenog zakona iz 2019. godine sudska praksa analizirana je i u odnosu na pravni kontinuitet i primjenu blažeg zakona

    Proračun kao ključan alat upravljanja državom koristi se za dodjelu resursa, postavljanje prioriteta i postizanje ključnih političkih ciljeva. Učinkovita proračunska kontrola i nadzor predstavljaju važne čimbenike dobrog financijskog upravljanja koji osiguravaju da se javna sredstva koriste učinkovito i djelotvorno. Na primjeru Hrvatske, rad analizira proračunski proces, izazove s kojima se susreću dionici proračunskog procesa te istražuje snage, slabosti, prilike i prijetnje u procesu donošenja proračuna. Dodatno, prikazuje ulogu nadležnih tijela u nadzoru osiguravanja zakonitosti, svrhovitosti i pravovremenosti korištenja proračunskih sredstava, ali i sredstva Europske unije. S tim u vezi, istražuje ulogu proračunskog nadzora u ostvarivanju proračunskih načela kao što su višegodišnje planiranje, dobro financijsko upravljanje i načela točnost

    Authors: Winter, Ivan Goran;

    Pravne posljedice osude veoma su značajan institut kaznenog prava, ali i mješovit institut, s obzirom na svoju pravnu prirodu, jer svojim dalekoseţnim djelovanjem i izvan kaznenopravnog područja u velikoj mjeri utječu na postpenalni ţivot osuĎenika, a koji utjecaj moţe ponekad i teţe pogaĎati od izrečene kaznenopravne sankcije. Iako ih sudovi, prilikom izricanja osuda ne izriču i često nemaju u vidu, upravo zbog navedenog značaja, nameće se potreba njihovog što jasnijeg i sveobuhvatnijeg pravnog ureĎenja i usklaĎivanja u smislu načela: ustavnosti, zakonitosti, razmjernosti. Premda se očito radi o mješovitom pravnom institutu, ipak valja imati u vidu da je osuĎujuća kaznena presuda s izrečenom sankcijom ona temeljna determinanta iz koje deriviraju sve potencijalne pravne posljedice iste. Stoga je upravo kaznenopravna materija temeljno područje u okviru kojega valja primarno procjenjivati i poticati što transparentnije i sigurnije njihovo ureĎivanje. S obzirom da upravo postojeće pravno ureĎenje ovog pravnog instituta, prema stajalištima eminentnih pravnih autoriteta, u Republici Hrvatskoj nije optimalno ureĎeno (posebno odnos Ustav Republike Hrvatske – glavno – posebno zakonodavstvo), što rezultira različitim dvojbenim interpretacijama, inzistiranje na njegovom poboljšanju.nameće se kao veoma aktualna nuţnost. Cilj ovog završnog rada je ukazati na historijsku prisutnost ideje na kojoj se pravne posljedice osude baziraju u hrvatskim povijesnopravnim izvorima mnogo stoljeća prije prihvaćanja i ozakonjivanja pravnih posljedica osude u danas poznatim okvirima. Zatim, kroz analizu pozitivnopravnog ureĎenja pravnih posljedica osude u Republici Htvatskoj ( s osvrtom na neke ustavnosudske odluke ) u svjetlu njihove povezanosti sa svrhom kaţnjavanja i rehabilitacijom u nuţnu i smislenu cjelinu, ukazati na nedostatke njihovog postojećeg zakonskog ureĎenja te s tim u svezi ponuditi odreĎene prijedloge.

    Authors: Varjačić, Ivančica;

    Prijetnje i nametljivo ponašanje oblici su nasilnog ponašanja u širem smislu te predstavljaju napad na osobnu sigurnost pojedinca. Prijetnje su prvi puta inkriminirane Kaznenim zakonom o zločinstvih, prestupcih i prekèršajih iz 1852. kao „zločinstvo pogibljenje prijetnje“, koje je kroz godine doživjelo transformaciju iz tog osnovnog oblika, materijalnog kaznenog djela do današnjeg oblika, apstraktnog ugrožavanja, dok je nametljivo ponašanje (tzv. „stalking“) u Hrvatskoj kažnjivo tek od 2013. godine. U radu je kroz povijest hrvatskog kaznenog zakonodavstva od 1852. godine prikazan razvoj prijetnji uz sentence sudskih odluka, a unutar kaznenopravnog okvira hrvatskog pozitivnog kaznenog zakonodavstva izvršena je analiza zakonskih opisa prijetnji i nametljivog ponašanja, raščlamba njihovih temeljnih obilježja kao i njihov međusobni odnos obzirom se u praksi nerijetko pojavljuju zajedno, sve uz analizu većeg broja presuda hrvatskih sudova. Poredbenim prikazom prezentirani su zakonski opisi iz slovenskog, austrijskog, njemačkog i srpskog kaznenog zakona uz sentence sudskih odluka. Zatim je temeljem statističkih podataka Ministarstva unutarnjih poslova, Državnog odvjetništva i Državnog zavoda za statistiku prikazana fenomenologija kaznenih djela prijetnje i nametljivog ponašanja, izrečene sankcije počiniteljima prijetnje za razdoblje 2004. – 2022. i nametljivog ponašanja za razdoblje 2013. – 2022. uz komentar o sigurnosnim mjerama kao posebnim kaznenopravnim sankcijama. Iako istražni zatvor i mjere opreza nisu kaznenopravne sankcije, njima se u zadire u prava i slobode građana tijekom kaznenog postupka stoga su u radu komentirani uz podatke o istima za razdoblje 2013. – 2022. U svrhu usporednog osvrta sa Hrvatskom, prikazani su podaci o broju osuda u poredbenim državama za razdoblje 2015. – 2021. I na kraju, provedenim istraživanjem i analizom, u zaključnom djelu rada rezimirano je mišljenje, uočeni problemi, opažanje i zaključci autorice rada.

    Authors: Ević, Danijel;

    This paper provides insights into the genesis of the Indian – Pakistani conflict and deals with the role of other actors in conflict resolution. The main premise of the paper is that the current conflict in the province of Kashmir will continue, and because of unwillingness for the dialogue of the conflict parties, a peaceful solution will have to be provided by the international community. The historical circumstances and the Indian – Pakistani wars are described, and the focus of this paper is placed on UN and its role in the Kashmir region and on the proposals for solving the „Kashmir issue“. Ovaj specijalistički rad daje uvid u genezu indijsko – pakistanskih sukoba te se bavi ulogom ostalih aktera u razrješavanju sukoba. Glavna premisa rada jest da će se aktualni sukob u provinciji Kašmir i dalje nastaviti, a mirnodopsko rješenje morat će dati međunarodna zajednica, s obzirom na nespremnost sukobljenih strana za dijalogom. Opisane su povijesne okolnosti te indijsko – pakistanski ratovi, a fokus rada je stavljen na ulogu UN-a u području Kašmira te prijedlozima za rješavanje „kašmirskog pitanja“.

    Od početka izbijanja epidemije koronavirusa (SARS-COV-2) krajem 2019. godine, kasnije nazvanom infekcijom COVID-19, ona je doživljavana primarno kao respiratorna bolest. Međutim, vrlo brzo je otkriveno da praktično nema organskog sustava koji ova bolest ne zahvaća, pa tako i uzrokuje oštećenje bubrega. Akutno bubrežno oštećenje je učestala komplikacija kod hospitaliziranih pacijenta s COVID-19 infekcijom, osobito kod osoba s pridruženim komorbiditetima kao što su šećerna bolest tipa 2. Kako je metformin jedan od najčešće korištenih oralnih hipoglikemika; lijek prvog izbora i linije; kod tih pacijenata je i povećan rizik za razvoj metaboličke laktacidoze. Laktacidoza uvjetovana uporabom metformina u terapiji je relativno rijetko zbivanje, no može uzrokovati teške komplikacije osobito kod osoba s bubrežnim oštećenjem. Zbog smanjenog izlučivanja putem urina dolazi do posljedične akumulacije metformina u organizmu te disbalansa u metabolizmu laktata te nastanka metaboličke acidoze. Kao dodatni čimbenik se izdvaja i dehidracija u sklopu ostalih simptoma kao što su proljev i povraćanje koji dodatno doprinose oštećenju bubrežne funkcije. U ovom prikazu slučaja se opisuje pacijentica s akutnom bubrežnom ozljedom, šećernom bolesti, laktacidozom uvjetovanom primjenom metformina s COVID-19 infekcijom te enterokolitisom uzrokovanim Clostridium difficile. Iako je laktacidoza opisana kao rijetka komplikacija uporabe metformina, ista može biti i fatalnog ishoda. Prikazane su i moguće životno ugrožavajuće komplikacije COVID-19 infekcije (plućna embolija) u razdoblju poslije bolesti COVID-19. Brzim pristupom nadomjesnom bubrežnom liječenju, bez odlaganja, unatoč tehničkim manjkavostima, dobrom organizacijom te požrtvovanošću medicinskog osoblja u izvanrednim uvjetima rada, mogu se postići uspješni rezultati liječenja kao i adekvatnog zbrinjavanja i liječenja mogućih komplikacija. Since the beginning of the outbreak of the corona virus epidemic (SARS-COV-2) at the end of 2019, then called COVID-19 infection, it has been seen primarily as a respiratory disease.However, it was quickly discovered that there is practically no organ system that is not affected by this disease, and thus causes kidney damage. Acute renal impairment is a common complication in hospitalized patients with COVID-19 infection, particularly in individuals with associated comorbidities such as type 2 diabetes. How metformin is one of the most commonly used oral hypoglycemics; drug of first choice and line; these patients also have an increased risk of developing metabolic lactic acidosis. Lactic acidosis due to the use of metformin in therapy is relatively rare, but can cause severe complications, especially in people with renal impairment. Due to reduced urinary excretion, there is a consequent accumulation of metformin in the body and an imbalance in lactate metabolism and the development of metabolic acidosis. An additional factor is dehydration as part of other symptoms such as diarrhea and vomiting, which further contribute to impaired renal function. This case report describes a patient with acute renal injury, diabetes, lactic acidosis due to metformin with COVID-19 infection, and enterocolitis caused by Clostridium difficile. Although lactic acidosis has been described as a rare complication of metformin use, it can be fatal. Possible life-threatening complications of COVID-19 infection (pulmonary embolism) in the post-covid period have also been presented. With quick access to renal replacement therapy, without delay, despite technical shortcomings, good organization and dedication of medical staff in emergency conditions, successful treatment results can be achieved as well as adequate care and treatment of possible complications.

    Authors: Hećimović, Davor;

    This paper deals with the notions of Eurasianism and its contemporary reincarnation of Neoeurasianism, as well as the ways in which these two ideologies have shaped modern Russian society and impacted how the Russian Federation conducts its foreign policy. The question of Russia's role in world history lies at the forefront of Eurasianist thought, while the solution it proposes greatly hinges on the idea of a Messianic third way positioning Russia as a dual culture bridging the gap between the West and the East. When talking about Neoeurasianism and Russian society, one should note that it, along with its supplementary concept of the „Russian World“, serves to fill in the ideological void left by the Soviet Union's abrupt demise, acting as a new state-building ideology that rationalises autocratic rule as being embedded into Russians' genetic code due to a Mongolic and Turkic legacy, which is why the Russian people have such a profound aversion to liberal democracy. Moreover, the Neoeurasianist line of thought has come to be perceived as a neoimperial and nationalist ideology harking back to Imperial Russia's dogmas about the triune Russian nation that must champion regional integration processes in the Post-Soviet space (EAEU, CSTO), firmly reject Western values and create its very own pole in the emerging multipolar world order. Against this backdrop, the war in Ukraine can be construed as a clash between Euro-Atlanticism and Neoeurasianism. U radu se problematiziraju ideja euroazijanizma i njezina suvremena iteracija neoeuroazijanizam te načini na koje su ove ideologije utjecale na suvremeno rusko društvo i oblikuju vanjsku politiku Ruske Federacije. Euroazijanizam je nastao kao odgovor na pitanje prirode Rusije i njezine sudbine u svjetskoj povijesti, a kao rješenje nudi svojevrsni mesijanski treći put kao dualne kulture koja premošćuje Istok i Zapad. Kada je riječ o neoeuroazijanizmu i ruskom društvu on, uz komplementarnu doktrinu „ruskog svijeta“, ispunjava ideološki vakuum nastao raspadom Sovjetskog Saveza kao nova državotvorna ideologija, racionalizira autokratske načine vladanja ističući turkijske i mongolske elemente u ruskom mentalitetu i odbojnost ruskog naroda prema liberalnoj demokraciji. Također se razvio kao konzervativna neoimperijalna i nacionalistička ideologija koja baštini dogme iz carskog razdoblja o trojedinom ruskom narodu koji mora predvoditi regionalne integracije na postsovjetskom prostoru (EAEU i ODKB), odbaciti zapadne vrijednosti i stvoriti zaseban pol moći u novom mnogopolarnom svjetskom poretku. U tom kontekstu rat u Ukrajini može se tumačiti kao sukob između euroatlantizma i neoeuroazijanizma.

    Authors: Župančić, Jana;

    Milenijalci su skupina koja se često zanemaruje prilikom sličnih istraživanja dok se najmlađe generacije često pojavljuju u kontekstu novih tehnologija i trendova vezanih uz korištenje društvenih mreža. Što ispitani milenijalci misle o načinu na koji sami koriste društvene mreže, ali i uočavaju li razlike ovisno o generaciji kojoj korisnik pripada, moguće je pronaći u ovom specijalističkom radu. Cilj je ovoga rada i istraživanja potaknuti daljnja istraživanja na slične teme, ali i usmjeriti pažnju na način na koji milenijalci vide svoje i tuđe ponašanje na društvenim mrežama. Interpretacijom i analizom odgovora koje su pružili milenijalci došlo se do saznanja o pasivnom načinu korištenja društvenih mreža kod milenijalaca koji su sudjelovali u istraživanju. Također je zamijećena korisnička apatija kod ispitanih milenijalaca. Millennials are a social group that often gets neglected in research of a similar type, while the youngest generations are often present in the context of new technologies and social media trends. What interviewed millennials think about their way of using social media, and if they recognize the differences between generations on social media, can be found in this postgraduate thesis. This thesis tries to encourage further research on similar topics and to bring attention to the way that millennials perceive their own and others’ behavior on social media. Through analysis and interpretation of answers that millennials gave, passive usage was recognized amongst millennials who were a part of this research. User apathy was also noticed among questioned millennials.

    Authors: Zrilić, Dario;

    Public relations are inseparable from ethics. A prerequisite for successful public relations is trust, because the true meaning of public relations is relationship, and without trust there is no successful relationship, therefore public relations are inseparable from ethics, and it is very important that public relations experts have a developed awareness of ethical principles. Management of communication with the public must be in accordance with regulations, authorities, acquired knowledge, code of ethics and harmonized with universal human ethical principles. Power and influence are also associated with public relations due to the possibility of influencing the attitudes and beliefs of the public, which further increases the need for the application of ethical principles. Some public relations theorists like Bernays believe that public relations professionals should manage and do manage almost all of people's daily activities because they understand the mental processes of the masses. There are many examples that expose the application of manipulative strategies and techniques in the public relations practice that have changed even the cultural patterns of the whole world. Ethics and ethical codes in the economy gained additional importance in the 1970s, when due to high inflation, economic crises and corruption scandals in the U.S.A. and Europe, intellectual circles paid more attention to moral values. In this paper, the theoretical part of the research is based on secondary data obtained using available literature and data. For the research and collection of primary data, the internet survey method was chosen on a sample of 174 adult citizens of the Republic of Croatia. The results of the research show that the perception of the public in the Republic of Croatia regarding the ethics of public relations is extremely negative in general and also according to a particular type of organization. The resaults of research also show that there is a connection between the perception of the PR ethics of an individual organization and the perception of the ethics of an individual organization on whose behalf PR acts, the more positive the perception of the ethics of the organization, the more positive is the perception of the PR ethics of that organization. It was also established that with increasing age, the perception of the public relations ethics in Croatia is more negative. Odnosi s javnošću su neodvojivi od etike. Preduvjet za uspješne odnose s javnošću je povjerenje jer je smisao odnosa s javnošću odnos, a bez povjerenja nema uspješnog odnosa, zbog toga su odnosi s javnošću neodvojivi od etike te je vrlo važno da stručnjaci iz odnosa s javnošću imaju razvijenu svijest o etičkim načelima. Upravljanje komunikacijom s javnošću mora biti u skladu s propisima, ovlastima, stečenim znanjem, etičkim kodeksom te usklađeno s univerzalnim ljudskim etičkim načelima. Uz odnose s javnošću također se veže moć i utjecaj zbog mogućnosti utjecanja na stavove i uvjerenja javnosti zbog čega dodatno raste potreba za primjenom etičkih načela. Neki teoretičari odnosa s javnošću poput Bernaysa smatraju da stručnjaci odnosa s javnošću trebaju upravljati i upravljaju gotovo svim svakodnevnim postupcima ljudi budući da razumiju mentalne procese masa. Postoji mnoštvo primjera koji razotkrivaju primjenu manipulativnih strategija i tehnika u praksi odnosa s javnošću koja je promijenila čak i kulturne obrasce cijelog svijeta. Etika i etički kodeksi u gospodarstvu su dodatno dobili na važnosti sedamdesetih godina kada su zbog velike inflacije, ekonomskih kriza i korupcijskih skandala u SAD-u i Europi intelektualni krugovi posvetili više pažnje moralnim vrednotama. U ovom radu teoretski dio istraživanja se temelji na sekundarnim podacima do kojih se došlo koristeći dostupnu literaturu i podatke. Za istraživanje i prikupljanje primarnih podataka je odabrana metoda ankete putem interneta na uzorku od 174 punoljetna građanina Republike Hrvatske. Rezultati istraživanja pokazuju da je percepcija javnosti u Republici Hrvatskoj vezano za etičnost odnosa s javnošću izuzetno negativna općenito i prema pojedinoj vrsti organizacije te da postoji povezanost između percepcije etičnosti PR-a pojedine organizacije i percepcije etičnosti pojedine organizacije u čije ime PR djeluje, što je pozitivnija percepcija organizacije to je pozitivnija i percepcija PR-a te organizacije. Također je utvrđeno da je s porastom dobi negativnija percepcija etičnosti odnosa s javnošću u Hrvatskoj.

    Authors: Haničar, Elizabeta;

    Authors: Lovrin, Iva;

    Stupanjem na snagu novog Kaznenog zakona 1. siječnja 2013. godine izmijenjen je koncept kaznenih djela protiv spolne slobode uvođenjem kaznenog djela spolnog odnošaja bez pristanka, posebno kažnjavanje u slučaju postojanja otklonjive zablude u odnosu na pristanak te je dana zakonska definicija pristanka kao i kada se smatra da takvog pristanka nema. Stupanje na snagu tog zakona izazvalo je brojne teorijske i praktične probleme. Zakonodavac je u ovoj glavi napravio još jednu izmjenu i to 2019. godine kada je kazneno djelo spolnog odnošaja bez pristanka brisano i postalo je stavak 1. kaznenog djela silovanja iz članka 153. U radu je iznesen pregled kaznenih djela protiv spolne slobode i njihov razvoj u Republici Hrvatskoj, razlozi za uvođenje u Kazneni zakon posebnog kaznenog djela spolnog odnošaja bez pristanka i nakon toga za njegovo brisanje. Analizirana je zakonska definicija pristanka na spolni odnošaj i s njim izjednačenu spolnu radnju, kada se prema zakonu smatra da takvog pristanka nema kao i uvedeno kažnjavanje počinitelja koji je bio u otklonjivoj zabludi o postojanju pristanka. Uz svako zakonsko rješenje izneseni su u literaturi uočeni teorijski i praktični problemi i njihovo moguće rješavanje kao i sudska praksa u razdoblju od 2011. godine do danas. Prilikom istraživanja za potrebe rada analizirano je 238 presuda koje se odnose na kazneno djelo silovanja i 100 presuda koje se odnose na kazneno djelo spolnog odnošaja bez pristanka (odnosno temeljno kazneno djelo silovanja nakon izmjene Kaznenog zakona iz 2019. godine) svih sudova u Republici Hrvatskoj. Izneseni su u praksi uočeni problemi u odnosu na razgraničenje temeljnog kaznenog djela silovanja (ranije kaznenog djela spolnog odnošaja bez pristanka) i kvalificiranog kaznenog djela silovanja. S obzirom na izmijenjeni koncept kaznenih djela protiv spolne slobode i izmjene Kaznenog zakona iz 2019. godine sudska praksa analizirana je i u odnosu na pravni kontinuitet i primjenu blažeg zakona

    Proračun kao ključan alat upravljanja državom koristi se za dodjelu resursa, postavljanje prioriteta i postizanje ključnih političkih ciljeva. Učinkovita proračunska kontrola i nadzor predstavljaju važne čimbenike dobrog financijskog upravljanja koji osiguravaju da se javna sredstva koriste učinkovito i djelotvorno. Na primjeru Hrvatske, rad analizira proračunski proces, izazove s kojima se susreću dionici proračunskog procesa te istražuje snage, slabosti, prilike i prijetnje u procesu donošenja proračuna. Dodatno, prikazuje ulogu nadležnih tijela u nadzoru osiguravanja zakonitosti, svrhovitosti i pravovremenosti korištenja proračunskih sredstava, ali i sredstva Europske unije. S tim u vezi, istražuje ulogu proračunskog nadzora u ostvarivanju proračunskih načela kao što su višegodišnje planiranje, dobro financijsko upravljanje i načela točnost

    Authors: Winter, Ivan Goran;

    Pravne posljedice osude veoma su značajan institut kaznenog prava, ali i mješovit institut, s obzirom na svoju pravnu prirodu, jer svojim dalekoseţnim djelovanjem i izvan kaznenopravnog područja u velikoj mjeri utječu na postpenalni ţivot osuĎenika, a koji utjecaj moţe ponekad i teţe pogaĎati od izrečene kaznenopravne sankcije. Iako ih sudovi, prilikom izricanja osuda ne izriču i često nemaju u vidu, upravo zbog navedenog značaja, nameće se potreba njihovog što jasnijeg i sveobuhvatnijeg pravnog ureĎenja i usklaĎivanja u smislu načela: ustavnosti, zakonitosti, razmjernosti. Premda se očito radi o mješovitom pravnom institutu, ipak valja imati u vidu da je osuĎujuća kaznena presuda s izrečenom sankcijom ona temeljna determinanta iz koje deriviraju sve potencijalne pravne posljedice iste. Stoga je upravo kaznenopravna materija temeljno područje u okviru kojega valja primarno procjenjivati i poticati što transparentnije i sigurnije njihovo ureĎivanje. S obzirom da upravo postojeće pravno ureĎenje ovog pravnog instituta, prema stajalištima eminentnih pravnih autoriteta, u Republici Hrvatskoj nije optimalno ureĎeno (posebno odnos Ustav Republike Hrvatske – glavno – posebno zakonodavstvo), što rezultira različitim dvojbenim interpretacijama, inzistiranje na njegovom poboljšanju.nameće se kao veoma aktualna nuţnost. Cilj ovog završnog rada je ukazati na historijsku prisutnost ideje na kojoj se pravne posljedice osude baziraju u hrvatskim povijesnopravnim izvorima mnogo stoljeća prije prihvaćanja i ozakonjivanja pravnih posljedica osude u danas poznatim okvirima. Zatim, kroz analizu pozitivnopravnog ureĎenja pravnih posljedica osude u Republici Htvatskoj ( s osvrtom na neke ustavnosudske odluke ) u svjetlu njihove povezanosti sa svrhom kaţnjavanja i rehabilitacijom u nuţnu i smislenu cjelinu, ukazati na nedostatke njihovog postojećeg zakonskog ureĎenja te s tim u svezi ponuditi odreĎene prijedloge.

    Authors: Varjačić, Ivančica;

    Prijetnje i nametljivo ponašanje oblici su nasilnog ponašanja u širem smislu te predstavljaju napad na osobnu sigurnost pojedinca. Prijetnje su prvi puta inkriminirane Kaznenim zakonom o zločinstvih, prestupcih i prekèršajih iz 1852. kao „zločinstvo pogibljenje prijetnje“, koje je kroz godine doživjelo transformaciju iz tog osnovnog oblika, materijalnog kaznenog djela do današnjeg oblika, apstraktnog ugrožavanja, dok je nametljivo ponašanje (tzv. „stalking“) u Hrvatskoj kažnjivo tek od 2013. godine. U radu je kroz povijest hrvatskog kaznenog zakonodavstva od 1852. godine prikazan razvoj prijetnji uz sentence sudskih odluka, a unutar kaznenopravnog okvira hrvatskog pozitivnog kaznenog zakonodavstva izvršena je analiza zakonskih opisa prijetnji i nametljivog ponašanja, raščlamba njihovih temeljnih obilježja kao i njihov međusobni odnos obzirom se u praksi nerijetko pojavljuju zajedno, sve uz analizu većeg broja presuda hrvatskih sudova. Poredbenim prikazom prezentirani su zakonski opisi iz slovenskog, austrijskog, njemačkog i srpskog kaznenog zakona uz sentence sudskih odluka. Zatim je temeljem statističkih podataka Ministarstva unutarnjih poslova, Državnog odvjetništva i Državnog zavoda za statistiku prikazana fenomenologija kaznenih djela prijetnje i nametljivog ponašanja, izrečene sankcije počiniteljima prijetnje za razdoblje 2004. – 2022. i nametljivog ponašanja za razdoblje 2013. – 2022. uz komentar o sigurnosnim mjerama kao posebnim kaznenopravnim sankcijama. Iako istražni zatvor i mjere opreza nisu kaznenopravne sankcije, njima se u zadire u prava i slobode građana tijekom kaznenog postupka stoga su u radu komentirani uz podatke o istima za razdoblje 2013. – 2022. U svrhu usporednog osvrta sa Hrvatskom, prikazani su podaci o broju osuda u poredbenim državama za razdoblje 2015. – 2021. I na kraju, provedenim istraživanjem i analizom, u zaključnom djelu rada rezimirano je mišljenje, uočeni problemi, opažanje i zaključci autorice rada.

    Authors: Ević, Danijel;

    Authors: Bosanac, Neven;
